Corpo's Use Middle East Addresses to Frustrate Employees' Rights

There's a standard corporate dodge encouraged by the Bush Administration that lets corpo's avoid paying taxes, duck any laibilities from poisoning the air or water, and stop unions from getting a foothold in their plants: register your headquarters in another country even though the offices are in the US (that's what the Panama trade deal was all about - the Democrats passed it, btw). Well, American corporations, thanks to a couple of Iraq-war profiteer-related legal decisions, have discovered a brand new use for the Foreign Registration Scam - short-circuiting their workers' rights as employees.

When William Christopher Hyser abruptly lost his job as a police trainer in Iraq - and his $16,000 bonus - he was so angry that he wanted to sue DynCorp, the Virginia-based defense contractor that hired him.

But when he called the company's complaint line, he was told that if he wanted to file a lawsuit, he had to do it in the United Arab Emirates. Like nearly 1,000 other American police trainers in Iraq, Hyser wasn't on the official DynCorp payroll - he was employed by a wholly-owned subsidiary set up in a tax-free-zone Dubai, a business-friendly citystate where labor unions are banned.

"I was so frustrated," said the former Maryland state trooper. "It just blew me away."

DynCorp, one of the largest US defense contractors in Iraq, is one of a small but growing number of US companies that mandate the use of courts in the Middle East to resolve disputes with their American employees. The practice frequently serves to block employees' lawsuits, legal specialists say, because few are able to navigate a still-developing foreign legal system in a distant land.

"The company has put up a hurdle that is probably insurmountable, or is just not going to be worth it to fight," said Richard Posthuma, an international labor specialist at the University of Texas, El Paso.

It's a simple - and apparently legal - scam. By assigning your headquarters officially to a country that doesn't recognize workers' rights, your workers won't have any.

"What is considered appropriate in workplace discipline in the Arab world is not considered appropriate in the US," said Paul M. Secunda, associate professor at Marquette University Law School, who co-authored a book on international employee benefit law.

In Saudi Arabia, it's considered "appropriate" to cut off the hands of an employee whose boss claims stole from the company. How far are US corpo's willing to go with this?

This practice may extend from - certainly it's been helped by - the decision of an ultraconservative Reaganite Federal judge last year that American businesses operating in other countries (in his case, Iraq) are not subject to US law.

The most damning part of Judge Ellis’ decision is the part that, if upheld, gets everybody who stole money in Iraq off the hook. Everybody. In that previous instance I just mentioned, Ellis’ argument went like this:

Last year, Ellis threw out a separate case against Custer Battles, after a jury awarded a $10 million judgment against the company over its work on a contract to replace the old Iraqi currency. Ellis ruled that any fraud was perpetrated on the CPA rather than the U.S. government, even though the U.S. government ultimately footed the bill. (emphasis added)

In recent months…Ellis…has twice invited the Justice Department to join the lawsuit without response. Even an administration ally, Sen. Charles Grassley, demanded to know in a Feb. 17 letter to Attorney General Alberto Gonzales why the government wasn’t backing up the lawsuit. Because this is a “seminal” case—the first to be unsealed against an Iraq contractor—”billions of taxpayer dollars are at stake” based on the precedent it could set, the Iowa Republican said.

Why hasn’t the administration joined the case? It has argued privately that the occupation government, known as the Coalition Provisional Authority, was a multinational institution, not an arm of the U.S. government. So the U.S. government was not technically defrauded.

The MidEast corpo's are essentially making the same argument: if their HQ is registered in a foreign country then they aren't subject to US law even if their physical HQ is clearly in the States. It's a technical, hair-splitting-type legal maneuver, so just to be on the safe side many of them are now requiring their employees to sign contracts acknowledging that the foreign country to which the company is sending them will have sole jurisdiction over any disputes.

DynCorp is not alone in employing strategies to limit its liability in dangerous locations, where the potential for employee lawsuits is great. The Houston-based construction giant KBR mandates that its employees sign arbitration agreements, barring its employees from filing suits in the United States or abroad. Blackwater, a major private security company, recently asked a US court to dismiss a lawsuit filed by widows of American soldiers killed in a plane crash because the crash happened in Afghanistan. Blackwater lawyers argued that Afghan courts should have jurisdiction.

But no company provides a more stark example of the tactic than DynCorp. In addition to listing its Iraq workers as employees of its Dubai subsidiary - and mandating that disputes be heard only in Dubai - DynCorp also added a provision to the contracts of roughly 150 Americans hired to guard a US military base in Qatar that the "courts of Qatar shall alone have jurisdiction" to resolve disputes.

Given that human rights isn't a big issue in most oil-bearing Arabic nation, signing a declaration like this is tantamount to signing away your legal rights altogether.

This can be stopped - very easily, actually - but it would take the Democratic Congress to do it and they've shown ZERO interest in stopping corporate abuses of workers here, let alone in other countries. There are startling investigations but so far NONE of them has resulted in a single law restricting corporate rights to treat workers like serfs.

I ain't holding my breath that that's going to change any time soon, not as long as the minority of Blue Dogs is allowed to hold the party hostage.

This is actually a tried and true tactic

Ever wondered why Liberia has the largest merchant shipping fleet in the world? It's because if you registered a ship in the US, it would be subject to lots of safety, labor and environmental regulations that shipping companies would rather avoid. So, you register your ships in Liberia, which doesn't bother with piddly little laws and regulations. So, despite the fact the shipping company is a US corporation, headquartered in the US, and with absolutely no operations in Liberia, it still registers the ships there. Now certainly Liberia isn't the only dodge. If you look at the cruise ship industry, you'll see that companies like Carnival also register all their ships in foreign countries.

It's starting to backfire on them

Based on a trade publication I receive, it's not working the way they wanted it to any more, because admiralty law is now being interpreted using the laws of the waters the ship sails through. Witness a recent incident with a Malta-flagged ship, with a Polish captain and largely Russian crew, which was "arrested" in rem in Baltimore harbor after the harbor pilots witnessed several flagrant safety violations (one of which being the bridge crew was, to a man, intoxicated). The ship was held for two weeks, its master faces prison time and fines approaching $350K, and the owners were out the use of that ship for the entire time it was held...and ask a ship owner how expensive it is to have a ship arrested in rem. They STILL have to pay the crew, it's not moving so it's not making them any money, and any freight on board risks loss of value.

I don't think that will change things much because it is still

cheaper for the shipowners to have pay and benefits based on the laws of a country other than the US. We may have one of the largest commercial fleets in the world in reality, but legally, countries like Liberia and the Bahamas will remain the largest.

The inland-waterway fleet is STILL all American-owned, American-crewed and (by law) American-flagged. And there's a huge labor shortage in that fleet. It's one of the better-kept secrets in the blue-collar work arena.

Of course, one of the reasons there's a huge labor shortage is that people who work the boats actually have to WORK for their money, and they have to prove they have a clue. Too many lives depend on it. And no, sheeple-trolls, I'm not just talking about the Deadliest Catch bullshit. Hundreds of mariners die every year from accidents and incidents in US waters alone...you just never hear much about them unless you happen to live in the port city where a particular vessel hailed from or where a given mariner lived.

This deserves more attention than it's gotten, and this should be an issue that's easy for Democrats to explain and use against the Republicans, except to the degree Democrats have been complicit. At least SOME Democrats should be able to use it, including ins primaries against blue dogs.

As bad as this is, I don't think it would be all that useful

in a campaign. The reason is that no one ever thinks they'll be in a situation like that until it happens. It's a hypothetical to most, and so it gets ignored, like the Alternative Minimum Tax. The most effective things are issues that get people emotional, sometimes to the point of irrationality. Take the issue of offshore drilling. The repubs have made it a big issue, and despite polls that say a majority of Americans believe it won't bring any real relief for over 10 years, and then only a few pennies per gallon, they still support it by a wide margin. Why? Because it is an emotional subject that impacts every single person every day. Why the hell do you think Perot failed in his presidential bid? Because he looked at problems in a logical, rational manner, with his charts and graphs. People ridiculed him for it without even paying real attention to what he was saying. Same for Gore in 2000.

Repubs learned under Raygun that a good, emotional appeal will always beat a reasoned, logical appeal, because the voters don't care to spend more than a few seconds thinking about any particular subject. It interferes with their enjoyment of "American Idol". So, create an issue, make it emotional, and beat your opponent over the head with it over and over again. Even better, make sure it is as inconsequential an issue as possible, such as gay marriage, so that you don't have to make any real important decisions.

work for should do a better job of self-policing then. If I'm someone working for Blackwater or Dyncorp, and I see a fellow contractor doing something unethical or illegal, I should report it to the company, and the company should take it seriously. Instead, everyone looks the other way, and the bad apples in the group can't even be prosecuted under Iraqi or American law. That's condoning dangerous behavior, and aiding and abetting a crime. If they aren't dealing with employees that pull that stuff, then yes, they are all guilty. That's a principle of law.

Red state people are "special"

I guess it's possible that more welfare recipients could be in blue states. It's just hard to believe. I work in the private sector and am a business owner. You work for the govt which makes you a socialist. Welfare recipients get their money the same way that you do. I proved that with food stamps, govt housing, farm subsidies and other govt handouts that 65% of welfare spending occurs in RED states. Hell, 60% of food stamps alone go to RED states. This is backed up by the appalling poverty, lack of education, inbreeding and just plain ignorance in the south.

And, why isn't Monkey Boy and McSame discussing withdrawal? They were the dumbasses who kept saying that when they stand up, we'll stand down; they're the assholes who keep saying that when the Iraqi government tells us to leave, we will. Why doesn't Big Oil drill on its existing leases? There are hundreds upon hundreds of acres of offshore drilling leases just flapping in the wind - why should Congress give them additional leases if they aren't using the leases they already have? Answer me that, Butthead.

Right now the oil companies own leases that they have the right to drill upon. Most already have the rigs set up and the drills ready, some are even off-shore. However, they are only drilling on 24% of these leases. The remaining 76% of their exisiting properties are being left idle because the oil companies themselves are colluding to restrict supplies to enable the price of oil to remain high. They are actually capping some of their rigs in Texas.

This issue of increasing drillings is just an attempt to add other currently non-leasable properties to their portfolio. Adding leases that are not even ready to be drilled from won't even come on line for 10 years at the earliest. But since they are already not bothering to increase the output or even drill on 74% of their existing properties with drills in the ground, what makes you think they will bother to invest in the infrastructure when they are making historical profits from the current situation?

Investing in efficiency and investing in the refining capacity of gasoline would increase the supply of gasoline that you buy at the pump, but interestingly enough, the refining capacity is not increasing ... and in fact, the corporate refiners are taking some of their refineries off-line on purpose to restrict the supply, and thus put upward pressure on the price Americans pay at the pump.

None of this has anything to do with what Democrats or Republicans do in Congress. However, Republicans who tout the issue of increasing drilling are doing so at the behest of the energy conglomerates who are manipulating the price of gas to add to their asset portfolio without actually increasing the supply of oil or gasoline at all.

In other words, it is a scam. They are pretending to be in the interest of the citizens when they are really just helping their masters gain more economic control of the nation's resources without changing anything at all, and trying to make the opposition party look like fools.

But the only fools are people like yourself who can't write complete sentences, and who allow themselves to be screwed by the economic agenda of the corporate elites with their self-serving public relations campaigns.

frogg has been great entertainment over the last few months. First he claimed the Nazi's weren't a fascist regime. The best part was watching him back pedal.

Then came the part where he demonstrated for us how trickle down economics doesn't work due to the selfish greed of the wealthy. There is no creation of new jobs by the wealthy. Just a hoarding of money under the bead. And frogg proved it.

The reason we need mercenaries

We have been involved in military action for years now in two nations (and more?). The reason this has been allowed to continue is because of all these people that just want to support a president with an R after his name. They don't know a damn thing but in polls and in the voting booth they give enough blind support to allow the politicians to justify continued action.

In years past Americans were brave and had honor. If they continuously voted to support military action they might consider joining up themselves or recruiting their younger family members to join.

But sadly the same republicans that have ignorantly supported this action have turned out to be selfish cowards. To get these cowards to even consider joining up the pot had to be sweetened. That's where the mercenaries companies like Blackwater come in. They essentially bribe the less cowardly republicans to serve. Without that extra cash these republicans aren't willing to serve.

If the republicans have their way we will be known as a nation of greedy cowards.
